HOW TO MAKE A COMPLAINT

What is Harassment:

“HARASSMENT” means any unwelcome sexual advance, request for sexual favours or other verbal or written communication or physical conduct of a sexual nature demeaning attitudes, causing interference with sexual nature or sexually demeaning attitudes, causing interference with work performance or creating an intimidating, hostile or offensive work environment, or the attempt to punish the complaint for refusal to comply to such a request or is made a condition for employment.

How to Approach us:
 

Any person, be woman or man, who is aggrieved by an act of Sexual Harassment committed by his / her employer or employee (colleague) may approach this Secretariat by presenting a written complaint through herself / himself or his representative to Registrar Office directly via post, courier services, fax, email or any other source of communication and having facility of nearby District Complaint Centers of this Secretariat, a complaint may also be presented personally.

Contents of Complaint:

- A comprehensive statement of all relevant facts consisting on occurrence of Harassment at the workplace, date of incident, place, time etc.

- Addresses of complainant and accused, name of organization, designations of both parties, contact numbers etc.

- Complainant must annexed all relevant documents to, in support of her / his complaint such supporting documents in respect of facts of incident may be documentary, video and audio as well and any other material, if any.

- Complaint must be submitted along with Affidavit, CNIC etc.

- Such complaint shall be duly signed by the complainant and if he / she cannot signed shall affix thumb impression whereas, affidavit must be duly signed by herself / himself and verified by oath commissioner.



How to register an Appeal:


Being aggrieved by the decision of competent authority of his / her organization, any victim party on whom any minor or major penalty is imposed may prefer an appeal under section – 6 of this Act to Ombudsman by presenting written memo / statement of appeal.
The appellant authority may on consideration of appeal and any other relevant material, confirm, set aside, vary or modify the decision within 30 days in respect of which such appeal is made. It shall communicate the decision both the parties and the employer.


Contents of Appeal:

  • All materials, statements and arguments relied upon by the appellant.

  • Evidences which were presented during the proceeding before enquiry committee.

  • Appeal shall be submitted directly to the Registrar Office of the Appellant Authority or through District Complaint Centers.

  • The contents of the appeal shall be duly signed, thumb impression where required, verified by the oath commissioner and appellant to be true to his/her knowledge and belief.
